Authorities have arrested HENRY CHMILELENKO after he shot his 6-month-old German Shepherd puppy named Kirk with a rifle.


On September 3, 2022, the Rio Rancho Police Department received two calls about a shooting at a home on 424 Southern Boulevard SW. The callers reported that CHMILELENKO was shooting his puppy.


A witness told police she was in her house when she heard a pop and when she lifted her curtains, she saw CHMILELENKO “wearing only a plaid shirt and no pants or underwear – holding a .22-caliber, gray rifle with a long scope.” She said that CHMILELENKO “was on top of his elevated wooden porch, just outside his front door, aiming at his dog running around the gravel at the bottom of the porch ramp.” The woman saw CHMILELENKO “take a second shot at the dog, which hit its rear end, cause the dog to yelp out in pain and run around the yard barking in pain.”


The report stated that the witness “said she was appalled and immediately ran over to Henry’s house in her pajamas. (She) explained she wasn’t going to let Henry kill his 6-month-old shepherd puppy.”


According to the report, officers “observed Kirk bleeding on the ground, with a gunshot wound to his rear area. He was still panting.” Rio Rancho animal control officer, Tim Lynch, responded to the scene and Kirk was rushed to a veterinarian where it was determined that Kirk had to be euthanized.


As CHMILELENKO was being placed under arrest, he told officers that Kirk was “going crazy and running around.”

To the officer’s question whether Kirk was attacking him, CHMILELENKO answered no.


In his home police found and confiscated a .22 Remington 597 rifle.


CHMILELENKO was arrested for extreme cruelty to animals and negligent use of a deadly weapon and was transported to the Sandoval County Detention Center.


Allow me to stray from this story to bring something to your attention.

I always Google the names of the people I mention in the stories I publish, and I found animal control officer Tim Lynch on Facebook.

On his profile, there is a picture which I found extremely devastating and totally inappropriate. A photo posted by Lynch shows him holding the head of a dead, bloody animal who has bullets on his/her body and a rifle propped against his/her lifeless body.

I would not expect an animal control officer, who’s duty is to protect and rescue animals, to be posing in such a tasteless and disturbing way.

I would expect more from an animal control officer who had also worked for the Rio Rancho Police Department!

~ Update: May 18, 2023


Erie County District Attorney John J. Flynn announced that 21-years-old JOELIER A. SANTIAGO (pictured) of Buffalo, was sentenced this morning before Buffalo City Court Judge Kevin J. Keane to a one-year conditional discharge.


As part of the sentence, the murderer was ordered to perform 360 hours of community service.


The murderer was also referred to the Court Outreach Unit: Referral and Treatment Services (COURTS) program for a mental health evaluation.


Judge Keane issued a final order that prevents the murderer “from owning or caring for any animals for the next five years”, also stated the release.


On March 14, 2023, the murderer pleaded guilty to two counts of Overdriving, Torturing and Injuring Animals; Failure to Provide Proper Sustenance (Class “A” misdemeanors under Agriculture and Markets Law).


The case was prosecuted by Assistant District Attorney Christine M. Garvey of the Animal Cruelty Unit.

On October 18, 2022, 21-years-old JOELIER A. SANTIAGO was arraigned before Buffalo City Court Judge Kevin J. Keane on two felony counts of aggravated cruelty to animals and two misdemeanor counts of overdriving, torturing and injuring animals; Failure to provide proper sustenance.

Court records show that SANTIAGO pleaded not guilty to the charges.


Erie County District Attorney John J. Flynn said in a press release that on December 29, 2021, SANTIAGO “intentionally caused serious injuries to two puppies under his care inside of an apartment on Louisiana Street in the City of Buffalo.”


One of the puppies, a 2-month-old male Maltese named Milo, was unresponsive when he was taken to the Greater Buffalo Veterinary Emergency Clinic. He was then transferred to the critical care unit at the Orchard Park Veterinary Medical Center where a veterinarian determined that the furbaby suffered severe bruising caused by excessive force and non-accidental injury.

Milo was surrendered to the SPCA serving Erie County and remains in the custody of a foster caregiver.


The second puppy, a 10-month-old female Maltese named Nala, sadly died from her injuries. A necropsy determined that the furbaby died from blunt force trauma caused by excessive force and non-accidental injury.


SANTIAGO was released on his own recognizance “as the charges are non-qualifying offenses for bail,” said DA Flynn. SANTIAGO is scheduled to return to court on Wednesday, November 9, 2022, at 9:30 a.m. for a felony hearing.

Judge Keane issued a temporary order that prevents SANTIAGO from owning or caring for any animals while his criminal case remains pending.


DA Flynn said that if SANTIAGO is convicted of the highest charge, he faces a maximum sentence of four years in prison.

~ Update: September 23, 2022


With regard to the other puppy, Ocho, the Sioux Falls Police Department told me in an email: “I read through the report and don’t see any mention of another animal. The suspect is still in jail, so if he had any other animals, our Animal Control Officers would have made sure they were placed in a safe environment.”

On Monday, September 19, 2022, Sioux Falls police arrested 21-years-old STEPHEN ALEXANDER MCILWAIN (pictured), for murdering a 3-month-old male Chihuahua-Dachshund mix puppy named Wybie.


Dakota News Now reports that last July a group of roommates took two puppies into their home, naming them Ocho and Wybie.


One of the roommates, Korey Schuld, told Dakota News Now that she was worried for Wybie, because one of the other roommates, MCILWAIN, had lost his temper with the puppy previously.


Sadly, on Monday, after Wybie relieved himself in the house (that’s what puppies do until properly and patiently trained), MCILWAIN savagely punched him in the chest, leaving behind marks.


Schuld told Dakota News Now: “Then I heard him crying, and I kind of knew what happened. I’ve been told to stay out of their business so that’s what I was doing but he was doing it for about two and a half hours. And then I went quiet.”


When the door opened, Schuld saw Wybie. She recounted the following moments and said: “I started doing CPR. And I did it for about five minutes. And his mouth was kind of open, so I ran to the kitchen to grab a butter knife. And I kind of put it in his throat so I could see in the back of it, and there was nothing he was choking on. But there was a bunch of blood in his mouth.”


Sioux Falls police responded and took MCILWAIN into custody.

He was booked into the Minnehaha County Jail on a felony animal cruelty charge.

KELO reports the murderer is being held on a $2,500 cash-only bond.


I have contacted the Sioux Falls Police Department to inquire about Ocho, the other puppy. I will post an update should I receive a response.
